Yünnan-fu, July 23, 1909. I HAVE the honour to enclose a copy of my despatch addressed to His Majesty's Minister at Peking, No. 34, of the 23rd July, on the subject of Burmese transfrontier cultivators and the suppression of opium in the Chinese Shan States.

I HAVE the honour to forward herewith a copy of my despatch, No. 30, of the 23rd July, and enclosure, addressed to the secretary to the Government of Burmah, ou the subject of alleged opium cultivation within the Chinese Shan State of Kengma by Burmese Shans residing at Malipa (latitude about 23° 40′).

I have also the honour to enclose a copy of the note from Tengyueh to Bhamo, dated the 25th May, 1908, to which reference is made in my despatch to Burmah.

Acting Consul-General Wilton to Government of Burmah,

Yunnan-fu, July 23, 1909. I HAVE the honour to forward herewith translations of a despatch from the Administrator of Foreign Affairs at Yünnan-fu, and of my reply, on the subject of alleged opium cultivation within the Chinese territory of Kengma by Burmese residing at Malipa.

If the facts, as reported by the Prefect of Shunning-fu are correct, it would appear that the case is one of transfrontier cultivation (see Tengyueh to Burmah of the 25th May, 1908).

It seems reasonable to expect that Burmese subjects who work fields within Chinese Shan territory should conform to the local laws in so far as they relate to these fields. The administrator's letter may be taken as authority that the law against the cultivation of opium in Yünnan is now also in force in the Chinese Shan States. Chinese and Burniese Shans would, therefore, appear to be precluded alike from growing opium within Chinese territory.
